The Safeguarding Letter

The Safeguarding Letter

Once the checks are complete, CAFCASS prepares a safeguarding letter for the court. This document highlights any risks or concerns and assists the judge in deciding how the case should proceed.

The safeguarding letter is usually shared with both parties. However, in cases where the information is particularly sensitive, some details may be withheld.

If you feel that important information has not been included in the safeguarding letter, such as your experience of domestic abuse, you can bring this to the court’s attention by completing Form C1A. Where allegations of domestic abuse are made, the court will expect evidence to be provided.

Appointment of a Children’s Guardian

In more complex cases, or where there are serious welfare concerns, the court may direct CAFCASS to appoint a Children’s Guardian. This is an independent officer who works alongside a solicitor to represent the child’s best interests throughout the proceedings.
